MBCR files court order for release of MBTA rail contract documents

Massachusetts Bay Commuter Railroad Co., which recently lost an upcoming eight-year contract to continue running the MBTA’s commuter rail system, is asking the T to immediately release public documents associated with the procurement process.

On Tuesday night, MBCR filed a complaint in Suffolk County Superior Court, nearly a week after the state transportation board unanimously voted to grant a multibillion public contract to Keoli to operate and maintain the commuter rail beginning in July.

In a statement released Tuesday night, MBCR said: “Following the January 8th meeting of the MassDOT Board of Directors, the MBTA promised the immediate release of the proposal submitted by the SNCF Keolis. Despite numerous public statements promising openness and transparency, the MBTA has yet to release the document.”

MBCR also filed an appeal with the Supervisor of Records at the Office of the Massachusetts Secretary of State, seeking review of what the company considers a failure on the MBTA’s part to comply with requests for public information.

In response to the injunction, the MBTA said the procurement process has been “open and transparent,” and that it has already posted key procurement documents on its website.

“The MBTA will continue to work to make much of the record of this procurement widely available. As soon as [Wednesday], the MBTA expects to post to its website an unredacted copy of the successful proposal,” T spokesman Joe Pesaturo said in an email.

“It is worth noting that MBCR has been resisting this effort at transparency, insisting that the MBTA is obligated to keep key parts of the MBCR submittal confidential and asking a court to prohibit the MBTA from making disclosures in response to public records requests.”
