Morales, 53, is claiming that he was permanently injured when a Department of Corrections bus he was on crashed into another bus on Rikers Island on Jan. 4, 2012, less than a month after Figoski was shot in the face and killed in a botched robbery.
The suit filed Friday in Bronx Supreme Court reportedly complains that Morales experienced "serious personal injuries and ... suffered shock, pain and mental anguish." He is seeking unspecified damages.
The City Law Department did not provide the Daily News with a comment.
Morales is reportedly scheduled to be tried this month.
