A defense attorney for the mother of a 5-year-old Fitchburg boy who was found dead by a Sterling highway said she is "substantially unable to participate in her own defense" because of psychological problems, The Boston Globe reported.
A status hearing was postponed Monday morning for Elsa Oliver, who has pleaded not guilty to charges of child endangerment in the disappearance of her son, Jeremiah Oliver.
Elsa Oliver's issues make it difficult for her to have "meaningful conversations," defense attorney James Reardon Jr. told reporters at Worcester Superior Court.
Though the 28-year-old has not been charged in the child's murder, Reardon said Monday it was “certainly possible” that prosecutors would file murder charges against Oliver, the Globe reported.
Oliver’s body was found earlier this month inside a suitcase near the roadway, seven months after his disappearance.
Though the boy went missing in September, his disappearance wasn’t reported until December. The death has prompted a criminal investigation and multiple examinations of the state’s Department of Children and Families.
