After DOMA decision, New York to award estate tax refunds to same-sex spouses

New York will give estate tax refunds to qualifying same-sex spouses after the Supreme Court found the Defense of Marriage Act unconstitutional last month.

Same-sex spouses previously had to pay expensive estate taxes when their partner died because their marriages were not legally recognized.

Edith Windsor, who was at the heart of DOMA’s overturning in her case, United States v. Windsor, is happy about the state’s news.

“I am of course thrilled that I will be getting a refund of the estate tax that I never should have had to pay,” Windsor said in a statement. “What makes me even happier is the fact that no other gay person will ever again have to face the indignity of DOMA.”
