Defence lawyers slammed Toronto police internal investigators yesterday after the Crown withdrew the remaining criminal charges against two former high-profile police officers.

Prosecutor Alex Hrybinsky told Superior Court there was no reasonable prospect of convicting William McCormack Jr. or Rick McIntosh because “crucial” wiretap evidence was unlawfully obtained.

When investigators filed an affidavit to obtain wiretap authorizations more than six years ago, they described the source of their information as a confidential informant to protect the identity of their police agent, Hrybinsky said.

It was therefore “inevitable” defence lawyers would have successfully challenged the validity of the authorizations.
