Two men involved in the botched robbery that ended with the shooting death of NYPD officer Peter Figoski are set to go on trial this week, the Daily News reports.

Nelson Morales, 28, and Kevin Santos, 32, and three other men attempted to rob a Brooklyn drug dealer in December 2011 before they were interrupted by police. When Figoski, 44, responded to the scene, he was shot and killed by Lamont Pride.

Pride was convicted in February and sentenced to 45 years to life. Michael Velez, the getaway driver in the case, was acquitted of all charges.

Morales was in the news again this March after he sued the city, claiming he was permanently injured when a Department of Corrections bus crashed into another bus on Rikers Island in January of 2012.

Nelson Morales, the alleged mastermind of the Brooklyn robbery that resulted in the death of NYPD officer Peter Figoski, is suing the city from behind bars, reports the NY Daily News.

Morales, 53, is claiming that he was permanently injured when a Department of Corrections bus he was on crashed into another bus on Rikers Island on Jan. 4, 2012, less than a month after Figoski was shot in the face and killed in a botched robbery.

The suit filed Friday in Bronx Supreme Court reportedly complains that Morales experienced ”serious personal injuries and … suffered shock, pain and mental anguish.” He is seeking unspecified damages.

The City Law Department did not provide the Daily News with a comment.

Morales is reportedly scheduled to be tried this month.

Last month, Lamont Pride was convicted of second-degree murder for Figoski’s death. In the same trial, the getaway driver, Michael Velez, was acquitted.

The man who shot and killed a police officer during a robbery in December was sentenced to 45 years to life in prison on Thursday.

Officer Peter Figoski, 47, responded to the scene of a burglary in the Cypress Hills section of Brooklyn early on Dec. 12. Lamont Pride and four accomplices were attempting to rob a drug dealer in a basement apartment. As Pride tried to flee, he encountered Figoski and shot him in the face.

Pride, 28, was convicted of second-degree murder, burglary and manslaughter. He was acquitted of first-degree murder which would have bought him a life sentence without parole.

Figoski’s mother, ex-wife and four daughters, ages 15-21, offered emotional statements about how much has been stripped away from their lives and futures with the killing of Figoski, the New York Times reports. But Pride offered no remorse, apologizing only to his own family in his last words before sentencing.

“And I want to let my two brothers know, as long as I got you in my corner till the end, we’re going to stand tall,” Pride said.

Justice Alan D. Marrus gave Pride the maximum sentence–45 years to life–but explained that it is his intention that Pride stays in prison for the rest of his life.

Michael Velez, the alleged getaway car driver in the robbery that led to the fatal shooting of NYPD officer Peter Figoski, was acquitted of all charges on Wednesday.

Velez, 22, was found not guilty of burglary and murder in the death of Figoski on the night of Dec. 12, 2011. Velez and four others were plotting to rob a drug dealer in a Brooklyn basement apartment, but were interrupted by police.

Velez had claimed that he was not aware that the other men were planning a robbery, the NY Post reported.

Lamont Pride, the man accused of shooting Figoski, was found not guilty on Monday of intentionally murdering a police officer, but was found guilty of second-degree murder, burglary and aggravated manslaughter. He faces 25 years in prison.

Lamont Pride was found guilty this morning in the murder of Officer Peter Figoski, the NY Post reported.

Figoski was killed while reporting to the scene of a burglary in East New York, where Pride and four other men were attempting to rob a drug dealer on December 12, 2011.

Testimony from the drug dealer was read during the trial.

Pride, 28, had confessed to possessing the gun and shooting Figoski, but claimed it was an accident. Pride said the gun discharged when he tripped as he was running away.

The jury of two men and 10 w0men found Pride guilty of second-degree murder and burglary, but not of the other four charges he faced, including first-degree murder.

If he had been found guilty of first-degree murder, he could have been sentenced to life in prison without parole.

The difference between first- and second-degree murder hinges in part on whether intent is proven; the jury asked the judge to define the term “intent” before delivering their verdict.

Figoski’s four daughters were present for the full two-week duration of the trial, according to the Post.

A jury is still out in the related case against Michael Velez, accused of being the getaway driver in the attempted robbery.
