An off-duty NYPD officer was shot late Sunday night as he tried to break up a domestic violence dispute in Queens, police said.

Joseph Koch was leaving a party when an 11-year-old boy came out of a nearby home shouting for help, saying his mother was being assaulted inside, cops said.

The boy’s mother reportedly told police that assailant broke into her apartment and burst into the room where she was with her son. The attacker reportedly began punching the woman in the face repeatedly, knocking her into a wall, she told police.

Cops said her son tried to stop his mother’s alleged attacker but the attacker punched the boy in the face and kocked him to the ground. He turned back to the boy’s mother and continued punching and kicking her in her face, head and body, police said.

That is apparently when the boy ran for help, encountering Koch.

The boy’s mother told police that Koch appeared in the doorway. She said she recognized he was a police officer because he had his gun drawn and she could see his badge.

The victim said that Koch told her assailant to stop and put his hands up, but the assailant lunged at the officer, attacking him.

The two struggled for the gun and three shots were fired, police said.

Koch was struck once in his left hand and the suspect was struck once in the lower abdomen. No one else was shot. Both Koch and the suspect were taken to Jamaica Hospital in stable condition. The domestic violence victim was also taken to Jamaica Hospital where she was treated for a laceration to the head, cops said.

The suspect, who has been identified as Jose Bernazard, 40, has been arrested and charged with five counts of assault, five counts of criminal contempt, aggravated harassment, burglary, endangering the welfare of a child, and resisting arrest.

UPDATE: The suspect who allegedly shot a police officer in the foot at Harlem Hospital Monday morning has been officially arrested and charged, the NYPD reported Monday night.

Guyteau Idore, 42, was charged with attempted murder, robbery, and assault.

Metro’s original story is below.

A police officer was shot this morning during a struggle with a man he had just taken into custody, and an EMT apparently came to the rescue, according to Police Commissioner Ray Kelly.

At a press conference at Harlem Hospital on Monday morning, Kelly described how the shooting occurred.

Police responded to a 4:44 a.m. 911 call reporting an assault in progress at 117th Street and Lexington Avenue in East Harlem, Kelly said. The caller reported that the alleged assailant had been throwing bottles and had assaulted another individual in the street.

Kelly said the responding officers, Fausto Gomez and John Chiodi, determined that the alleged assailant, identified by police as Guiteau Idore, 42, was emotionally unstable. They were able to handcuff him and load him into an ambulance manned by EMT Brandon Hernandez, Kelly said.

Kelly said Chiodi accompanied Idore and Hernandez in the ambulance for psychiatric evaluation at Harlem Hospital. Gomez followed in a marked patrol car.

When the ambulance arrived at Harlem Hospital and Chiodi attempted to unload Idore from the ambulance and walk him up the emergency room loading ramp, Idore began to struggle and attempted to flee, Kelly said.

Gomez and Chiodi reportedly grabbed onto Idore and were on either side of him when they reached the top of the ramp, Kelly said. Despite being handcuffed behind his back, Idore was somehow able to remove Chiodi’s service weapon from his belt and fire it twice, grazing Gomez’s left foot once.

EMT Hernandez leapt into action, according to Kelly’s report, and managed to wrest the gun from Idore’s hand and ”racked it, to make it safe,” according to Kelly.

An NYPD spokesperson explained this as moving the top slide portion of the gun to the rear, locking it in place and making it impossible to fire unless racked a second time.

“He did an outstanding job,” Kelly said.

Idore was removed to Metropolitan Hospital for psychiatric evaluation, Kelly said. He allegedly has “extensive arrest history, including assault, menacing and numerous domestic violence incidents.”

According to Kelly, Hernandez has aspirations of becoming an NYPD cop.

“He certainly demonstrated that he has what it takes to do the job,” Kelly said.

Gomez was in good condition and reportedly about to be released at the time of Kelly’s remarks.

Mayor Michael Bloomberg was also at the hospital to speak with Gomez and his family.

“Because his injury wasn’t that serious, it was a lot easier to have that kind of conversation than sometimes when the officer is injured much more seriously,” Bloomberg said.

After repeated calls via Twitter at the height of last night's violence for outsiders to leave the community alone, Councilman Jumaane Williams again requested that "outsiders" abstain from rallying youth to action without proper training and strategy, but said that he believes those outsiders are well-intentioned, and welcomed them. "I think they're concerned and want to help," Williams said. "I just want to make sure that our young people's anger is channeled productively." "We want you, but be constructive; don't endanger our kids," he added. Williams refused to identify who he sees as "outsiders," asserting that doing so would be counterproductive. He also asked that the community withhold comment on either side until a thorough investigation has been completed. The sisters of Shantal Davis, an unarmed woman killed by police last June, spoke as well, urging the community to attend meetings they hold on Monday at 39th Street and Church Avenue. Other speakers mentioned Williams' efforts to find a location in the neighborhood to establish a community center. Gray's father stood by Councilman Williams, but chose not to speak. Speaking on his behalf, Williams told the crowd the elder Gray was "not happy with the violence occurring," but wanted peaceful, organized marches and protests. A man who identified himself as a former member of the Bloods gang said he came from "the same thing Kimani came from." He called the police murderers, noting that Gray was shot three times in the back. According to the autopsy report, Gray was shot a total of seven times. Three shots were to his back. The repeated theme, from clergy, community members, and elected representatives, was that action was needed, but it must be organized. Williams lamented the handful of youth who "unknowingly violated parole last night," using this as an example of the negative consequences of inciting youth to action without properly informing them of consequences. As the crowd disbanded, a young man began to shout at nearby police, calling them "occupiers." "This is Palestine!" the young man cried. "And last night was Syria!"    Follow Danielle Tcholakian on Twitter @danielleiat]]> kimani gray memorial

Following a third night of unrest during what was meant to be a vigil for 16-year-old Kimani Gray, shot by cops last weekend after reportedly pointing a .38 caliber gun at them, local City Councilman Jumaane Williams held another press conference Thursday afternoon with other community leaders, asking the public to respect the wishes of Gray’s family and maintain peaceful protests and marches, but abstain from further violence.

After repeated calls via Twitter at the height of last night’s violence for outsiders to leave the community alone, Councilman Jumaane Williams again requested that “outsiders” abstain from rallying youth to action without proper training and strategy, but said that he believes those outsiders are well-intentioned, and welcomed them.

“I think they’re concerned and want to help,” Williams said. “I just want to make sure that our young people’s anger is channeled productively.”

“We want you, but be constructive; don’t endanger our kids,” he added.

Williams refused to identify who he sees as “outsiders,” asserting that doing so would be counterproductive. He also asked that the community withhold comment on either side until a thorough investigation has been completed.
