Police arrest escaped Del. woman, ‘kicking and spitting’

Delaware State Police on Monday arrested a woman who allegedly escaped custody while receiving treatment at a hospital.

Police said Shirley Smith, 32, was spotted around 3:45 p.m. in the parking lot of the Dover Downs Hotel and Casino.

Officers saw Smith enter a car and leave the parking lot.

Troopers then stopped the vehicle, according to investigators.

Smith allegedly refused to get out and had to be dragged from car as she attempted to kick and spit on the arresting officers.

Smith is charged with two counts of offensive touching of another with saliva, criminal impersonation, resisting arrest, escape and resisting arrest with force or violence.

She is jailed at the Baylor Women’s Correctional Institute in lieu of $7,100 bail.

Police said Smith was originally arrested the morning of April 17, when troopers responding to a domestic disturbance at a home on Bertha Drive found her hiding in a closet.

They said Smith provided them with a false name but officers determined her true identity and found she was wanted on several outstanding violations.

Smith allegedly spit on a resident of the home and a trooper as she was being taken into custody.

Police said she complained she needed immediate attention for a preexisting medical condition unrelated to the arrest.

They took her by ambulance to Kent General Hospital.

Smith allegedly fled from the hospital without receiving treatment and was on the lam until Monday afternoon.
