The 58-year-old man who was shot by a Milford Police officer died Monday night, state police said.

Roy D. Rhodes, of Milford, suffered multiple gun shots around 4 p.m. on the 600 block of Milford Harrington Highway on Dec. 14 after he pulled out a gun and pointed it in an officer’s direction, according to state police.

Delaware State Police were asked to investigate Saturday’s police-involved shooting between Rhodes and the Milford Police officer , who has 18 years experience, police said.

“The Delaware State Police Homicide Unit continues to conduct the investigation at the request of the Milford Police Department,” according to a news release. “This continues to be an active investigation with State Police Detectives continuing their investigation, evidence processing, and interviews.”

According to police, Rhodes crossed his 1998 Lincoln Town Car from the westbound lane of Milford Harrington Highway into the eastbound lane and into the path of an oncoming car.

The car avoided a collision, but Rhodes veered off the side of the road, crashed into some bushes and came to a stop in a private driveway off the highway, police said.

The other driver got out of his car and approached the Lincoln to check on Rhodes. When he visited the driver-side door, he found Rhodes holding a knife to his throat. The driver quickly reached through the window and grabbed the weapon, police said.

Rhodes became upset, pulled a handgun from the center console, and then exited the Lincoln as Milford Police arrived, police said.

Police said they ordered Rhodes to drop the gun several times, but he did not comply.

Police said Rhodes then pointed the gun at police, at which point the Milford officer fired multiple shots which hit Rhodes three times in the upper and lower body.Rhodes remains in critical condition at Milford Memorial Hospital.

Rhodes remains in custody at Milford Memorial Hospital and faces charges of aggravated menacing and possession of a firearm during the commission of a felony. He will be arraigned after he is medically cleared.

The Milford officer was placed on administrative duty as departmental policy, pending the outcome of the investigation. The Officer’s name will not be released at this time.
