An expelled state legislator who was convicted of assaulting a former girlfriend was released from a Billerica jail Wednesday, according to the Middlesex County sheriff’s office.

Carlos Henriquez, a Boston Democrat, was voted out of the Massachusetts House of Representatives in February by a 146-5 vote after he was sentenced to six months in jail.

On Jan. 15 Henriquez was convicted on two misdemeanor charges of assault and battery stemming from allegations that he kidnapped, backhanded, choked and punched a 23-year-old woman in a rental car in July 2012.

The state parole board granted his early release under the conditions that he wear a GPS monitoring device, stay away from the victim and enroll in a counseling program for batterers.

Henriquez has maintained his innocence and is appealing has conviction.

At the Feb. 6 vote, Henriquez told House members “I used to think that the good of many outweighs good of the few. Now I wonder at what cost.”

“An innocent man does not plead, and an innocent man does not quit,” he said.
