State Senate passes bill to outlaw revenge porn

The New York state Senate passed a law on Wednesday that would criminalize the sending of private illicit images without consent from the person in the photos.

In New York, existing laws already includes language against harassment through “electronic means,” and protects individuals who do not know that explicit images of them have been taken and are being distributed.

However, the proposed law would expand those protections and make it a misdemeanor the first time private, intimate images are published with the intent to harm or harass.

“These private images go viral to the world and there is little or no legal recourse afforded to the victims,” bill sponsor state Sen. Phil Boyle said in a statement.

“This legislation would give our law enforcement officials the tools they need to protect New Yorkers from the devastation wrought by revenge porn,” he added.

As a misdemeanor, the first offense can land those found guilty with up to a year in jail. A repeat offense within 10 years can be charged as a felony with the risk of up to four years in prison.

Boyle introduced the bill 2013 and modeled it after legislation passed in California, one of nine states around the country with laws on the books specifically addressing revenge porn.

A similar bill awaits votes in the state Assembly before the Legislature adjourns for the year on June 19.
