Man arrested for allegedly opening fire on neighbor over ATV dispute

Delaware State Police on Monday arrested a Camden-Wyoming man for allegedly opening fire on his neighbor after becoming angry when police failed to resolve to his liking a dispute involving ATVs being driven near his property.

Investigators said James Erbaugh, 66, around 6:30 p.m. called troopers to the unit block of Firetower Road, complaining that ATVs were being driven on the street.

Though responding officers saw no traffic offenses, troopers made contact with some youths in the area, who were released without any further action.

Erbaugh was contacted and “appeared despondent with the outcome,” according to authorities.

Police said troopers were shortly after leaving the area called back to block for a report that Erbaugh was shooting his gun in the direction of a 32-year-old neighbor that was outside with six other people – four of them young children aged 7, 5, 4 and 1.

Further investigation allegedly revealed after officers left the block, Erbaugh came out of his house armed with a .22-caliber handgun, shouted “harassing statements” to his neighbor and fired several shots in the direction of a dirt pile located about 160 feet from the neighbor’s home.

Erbaugh was taken to Troop 3 and charged with seven counts of reckless endangerment, three counts of harassment and one count of possession of a firearm during the commission of a felony.

He was jailed at the Sussex Correctional Institution on $51,000 secured bond.

Erbaugh was also issued a no-contact order with any of the seven victims and required to surrender all weapons in his home.
