Man convicted of raping 5-year-old godson faces 101 years in jail

A Philadelphia man was today convicted by a jury for repeatedly raping and sodomizing his five-year-old godson between 2009 and 2011. He now faces up to 101 years in prison, prosecutors said.

The abuse began when Eric Maloy, 44, started watching the young victim, whose working mother couldn’t afford day camp, according to a release from the District Attorney’s Office. Malloy was today found guilty of rape, involuntary deviate sexual assault and indecent assault of a child, as well as endangering the welfare and corrupting the morals of a child.

“This child showed
enormous courage in testifying to such horrible crimes and by doing so
has protected other children in our community,” Assistant District Attorney Branwen McNabb said in a statement.

Prosecutors said Maloy has in the past been arrested for numerous child rapes and a murder, but was never convicted. In at least one of those cases, the now-adult victim testified that Maloy sent him out of state at the time so he could not be found when it came time to speak at his trial, the District Attorney’s Office said.

The District Attorney drew parallels to Maloy’s most recent case, in which two crucial witnesses “mysteriously relocated to Georgia just weeks before the trial,” according to the release. The testimony in the case included two of Maloy’s previous alleged juvenile victims, who are now men in their 20s.

The men said that Malloy also sodomized them when they were between the ages of 13 and 18 and had been sent to live with him because their biological parents were unable to care for them. “Maloy developed a pattern of identifying vulnerable
children and then assuming a parental role in order to satisfy his
sexual desires,” the District Attorney’s Office said.

Assistant District
Attorney Ashley Lynam, who helped prosecute the case, said in a statement that “the Commonwealth will be seeking the maximum
period of incarceration.” Maloy will be sentenced on March 15 and faces a maximum of 101 years behind bars.
