Tsarnaev wants some Boston bombing charges dropped at April 16 hearing

The man who federal prosecutors allege carried out the deadly Boston Marathon bombings wants some of the 30 related charges dropped, a request that will be considered during a hearing a year and one day after the terror attack took the lives of three people and injured 260 more.

The AP reported that U.S. District Judge George O’Toole today said he scheduled a hearing for April 16, meaning Dzhokhar Tsarnaev could possibly appear in federal court in Boston a day after the city marks the one-year anniversary of the bombings, though a spokeswoman for U.S. Attorney Carmen M. Ortiz said it is unlikely Tsarnaev will make an appearance.

Defense attorneys for Tsarnaev requested the hearing.

O’Toole said he will also hear a request to lift special restrictions placed on Tsarnaev while he awaits trial. Tsarnaev is in solitary confinement at Ft. Devens.

The 20-year-old has pleaded not guilty to a 30-count indictment that includes conspiracy, using a weapon of mass destruction and a slew of other charges.

His lawyers claim many of the charges are redundant and could sway jurors weighing whether to find him guilty and whether to sentence him to death, the AP reported.

More than half the charges carry the possibility of the death penalty. Attorney General Eric Holder has approved the pursuit of execution.
