Cop: Officer put baton in man’s rectum

A transit cop yesterday testified that a fellow officer put a baton into the rectum of a man police were arresting in a subway station.

Officer Kevin Maloney, 27, testified for the prosecution against Officer Richard Kern who is charged with sodomizing Michael Mineo. Officers Alex Cruz and Andrew Morales are charged with covering up the incident.

Officers had chased Mineo into the Prospect Park B and Q station after spotting him smoking pot.
Maloney, considered the prosecution’s star witness, said Kern pressed retractable baton against Mineo’s left buttock.

“It went from left to right into Michael Mineo’s butt crack,” he said. “A half inch to an inch was out of sight.”

Prosecutors say Mineo’s DNA was on the baton.

Mahoney is the first witness to back up Mineo’s claim of sexual assault. Jurors have heard witness accounts of the incident.

The defendants’ lawyers  say Mineo is making up the story in hopes of a windfall from his $440 million lawsuit against the city.
