On his sixth and final day testifying against his former crime partner, Stephen Flemmi talked about prison food and having hope that one day he will not be in jail.
Flemmi, 79, wrapped up testimony on Thursday after Bulger attorney Hank Brennan finished his cross examination and a prosecutor finished a brief re-questioning.
Brennan spent part of Thursday’s cross examination asking Flemmi about the prison facility in which he is being held. Flemmi is in a special facility for inmates in the witness protection program.
Brennan suggested Flemmi had access to a store with a deli.
“If I fed that food to my dog, it’d bite me,” Flemmi said.
Flemmi was then asked by Brennan about Fourth of July and Memorial Day celebrations at the facility.
“The hot dogs were burnt. The hamburgers were burnt,” Flemmi said.
Also during cross examination, Brennan asked Flemmi about Rule 35, a legal rule that allows the government to request an inmate’s sentence be reduced if the inmate provides substantial assistance.
“I’m still alive. There’s always hope. You never know,” Flemmi said.
Brennan then quickly asked, “And certainly that’s an incentive to please the government right, Mr. Flemmi?”
But during re-questioning, Assistant U.S. Attorney Fred Wyshak asked Flemmi if anyone has told him he’d serve anything but a life sentence.
“No,” Flemmi said.
