Daniel Donovan, the prosecutor in the Eric Garner chokehold case, is soon to be a U.S. Congressman.

Donovan was elected to the U.S. House of Representatives in a special election on Tuesday, making him the only Republican from New York in the House.

As Staten Island District Attorney, Donovan presided over the investigation and controversial Grand Jury decision on the death of Eric Garner after policemen appeared to place him in a chokehold last summer.

The grand jury’s decision not to hold NYPD officer Daniel Pantaleo responsible for Garner’s death lead to more protests in New York City and calls from civil rights activists for a special prosecutor to re-examine the case.

Donovan is taking over the seat vacated by Michael Grimm earlier this year after Grimm was indicted by federal authorities on several fraud and tax charges.
