Kelly trial-week-to-date recap

Danieal Kelly’s father Daniel should be testifying this morning in his child-endangerment trial. I’ll file reports as soon as he’s done, but here are the past two days of stories to get you up to speed on where things stand.

From Monday:

After two workers for MultiEthnic Behavior Health Inc. testified to producing false reports regarding the Kelly case that the contracted social-services company provided DHS, Daniel Kelly sat in the courtroom betraying little emotion yesterday. That came after his ex-girlfriend Kathleen John, with whom he had three children but not Danieal, spoke about instances when he spit on and hit her with a telephone and struck his namesake son when they lived in Arizona in the early ’00s.

She said that after they split up, Daniel would leave the children home alone when he went to work at nights, but left her phone number in case of emergency. John lived about 15 miles away.

“He never hit and was never, ever abusive” toward Danieal, she said. “He always took care of her.”

When John testified that the last time she’d seen her ex-husband was at Danieal’s funeral, she broke down into tears. Daniel Kelly gulped several times, fighting back emotion.

From yesterday:

When Danieal Kelly’s aunt and grandmother traveled across the state to visit the girl in 2005, the girl’s mother sent word that “she was not presentable” so they never saw her. Their trip came after months of not being able to track the girl down since Andrea Kelly had closed their side of the family off from seeing her, her aunt Jana Hines testified yesterday.

“Andrea would not let us know where [Danieal and her brother Daniel Jr.] lived,” testified Hines, who drove more than seven hours from near the Ohio border where Danieal and Daniel lived with her in 2003. “He loved Danieal. She was singing, talking; she was not a normal cerebral palsy child because he didn’t baby her.”

Daniel Kelly is slated to testify today and closing arguments are expected to start in the child-endangerment trial against him and two social workers for negligence. Prior to Hines’s testimony, witnesses from the state Department of Health and Human Services focused on allegedly fraudulent record-keeping at MultiEthnic Behavioral Health Inc.

An HHS investigator spoke to finding bags of paperwork related to the case in a Dumpster behind the social-services operation while a forensic computer analyst testified about reports that were created the day of Danieal’s 2006 death being made to look like they were from months earlier.
