Boobie bracelet ban may be brought before US Supreme Court

The Easton Area School District voted 7-1 Tuesday night to appeal to the U.S. Supreme Court after a federal court did not uphold the district's decision to ban the bracelets, according to The Express-Times of Easton, Pa.

The rubber "I (heart) boobies" bracelets may soon be found on the floor of the highest court in the country.

The Easton Area School District voted 7-1 Tuesday night to appeal to the U.S. Supreme Court after a federal court did not uphold the district's decision to ban the bracelets,according to The Express-Times of Easton, Pa.

Two girls, then aged 12 and 13, were suspended by the school district in 2010 for wearing the bracelets, which are intended to help promote breast cancer awareness. The districtclaimed they are of a suggestive and lewd nature.

The middle-school students fought the decision, which has taken both parties through two Circuit Court of Appeals, which both favored the girls.

Superintendent John Reinhart told the newspaper that the Third Circuit Court, which upheld a lower court's decision that the bands were not lewd, "Compromised administrators' abilities to intervene in what is and what is not appropriate in school."

Board member Frank Pintabone, the lone dissenting vote, said the district should just let it go.

"I think we should be done with it. Let it go. We lost 20, 30 times, I don't even know anymore," Pintabone said.
