Kenneth Moreno, the former NYPD officer acquitted of rape, will not face charges for heroin found in his locker, prosecutors said yesterday.

 

Moreno faced misdemeanor charges for the two packets of heroin found in his locker, which Moreno’s lawyer had argued was shared by several other officers.

 

The heroin was found during a search of his locker after he was arrested for rape in 2009.

 

He was sentenced to a year in jail for official misconduct. His co-defendant, Franklin Mata, was sentenced to 60 days in jail, and both are free on bail while they appeal.

 

Prosecutors said they did not see a need for pursuing the case.
