Guilt by a Twitter post?

Be careful what you tweet.

Twitter posts could be used as evidence in an upcoming murder trial.

Jameg Blake, 22, is accused of shooting Kwame Dancy, 22, outside Gov. David Paterson’s Harlem home in November, after the two exchanged barbs on Twitter. Prosecutors may use the tweets as evidence of an ongoing feud.

“This is the first I’ve heard of ‘tweets’ being used as evidence, but as Twitter grows in popularity, this could become more common,” said Manhattan-based attorney Steven Hoffner.

“If you’re using Twitter you’re sending it into the public domain — you don’t have privacy,” said Hoffner. “If it was an e-mail or cell phone record, the government would have to subpoena the records.”
