Owner fined, still says club was under capacity

A fire department spokesman said Monday that it was unlikely the club would be fined because fire officials arrived at the Stuart Street club after police had dispersed much of the crowd. However, the decision to levy the $100 fine was made after reviewing more reports, said Steve MacDonald, the spokesman.

MacDonald said inspectors checked the manual counters the night of the event and those showed there were between 25 and 30 more people in the club than its capacity of 292.

“We were under capacity,” said Darrin Morda, the club owner, who added he did not think he would fight the fine. “Our only goal at this point is to simply open our doors.”
