Middlesex District Attorney Marian Ryan should resign after her office released Jared Remy on his own recognizance just a day before he allegedly killed his girlfriend, a state representative said.

Rep. Jim Lyons, a Republican from Andover, said Saturday that Ryan should resign her office and other politicians should demand she do so.

“Governor Patrick should demand the immediate resignation of his appointment Marian T. Ryan as Middlesex district attorney,” Lyons said in a statement posted on his Facebook page. “The fact that the district attorney allowed Jared Remy back on the street after he assaulted Jennifer Martel is inexcusable. The system failed this women [sic] and her family.”

Remy allegedly fatally stabbed his girlfriend, Martel, late Thursday night their Waltham home. He pleaded not guilty Friday.

Remy, the son of Red Sox broadcaster Jerry Remy, was also arrested Tuesday night for assault and battery, but was released on his own recognizance on Wednesday after discussions with the arresting officer and Martel, Ryan’s office has said.

A spokeswoman for Ryan said that Lyons was trying to “politicize” the case.

“This is an unfortunate attempt to politicize a tragic situation. Our focus is on prosecuting the person responsible for killing Jennifer and seeking justice for her and her family,” said MaryBeth Long, Ryan’s spokeswoman.

Jerry Remy issued a statement Saturday through his Twitter page.
