An 18-year-old Halifax man is facing charges of assault causing bodily harm and breach of an undertaking following an incident on LeMarchant Street in Halifax early Saturday morning.

Police say the victim was approached around 1:30 a.m. by the suspect who asked for a cigarette. When the male victim refused, police say he was punched to the ground, then kicked in the face. Police say the man was taken to hospital with non-life threatening injuries, while an 18-year-old was arrested without incident.

Luke Patrick Uteck, son of Northwest Arm-South End Coun. Sue Uteck, was in Halifax provincial court yesterday and was released on conditions with his next court apperance set for Dec. 26.

Uteck is also before the courts on other charges including assault causing bodily harm stemming from two separate incidents on July 26.
