Spirits soar at whisky distillery after victory in trademark battle

Officials at Glenora Distillers, Canada’s only single-malt whiskey distillery, were raising a glass in toast Thursday after the Supreme Court of Canada dismissed an appeal against its trademark spirit.

Company officers said in a news release Glen Breton will be registered under the Trademarks Act of Canada after a nine-year battle ended with the court’s dismissal of an application by the Scotch Whisky Association for permission to have a third appeal on its opposition to the registration of Glen Breton.

Registration had been approved by the Federal Court of Appeal in a decision delivered in January.

“We take pride in having seen this fight through its final contest, which is well and truly the tradition of my Scots forefathers, and of the Cape Breton heritage in which I was raised,” said Lauchie MacLean, Glenora Distillers president. “We met them in the glen. Now comes the end of the day, and that glen is ours.

“George Bernard Shaw once said ‘Whisky is liquid sunshine.’ No truer words were spoken, for the sun is shining today on Glenora. Our glasses of Glen Breton do shimmer and sparkle as we toast this happy conclusion to our campaign.”
