Town sentenced in death

Judge Jamie Campbell yesterday imposed sentencing measures of about $110,000 on the Town of New Glasgow for its role in the workplace fatality which claimed the life of public works employee Michael Bonvie.

Bonvie was killed when the trench he was working in to install water and sewer lines collapsed on the morning of Oct. 26, 2006.

New Glasgow CAO Lisa MacDonald accepted the court’s sentence, noting the town has already accepted responsibility for the fatality, and resolved to make changes to guard against a recurrence.

The judge ordered the town to pay a fine of $25,000 “to provide a level of compensation to the Crown for the cost of the investigation and prosecution of this matter.” Campbell wrote. The town will additionally pay a victim surcharge.

A list of additional measures requires the town to pay for quarterly audits of its safety programs. The audits are to be finished by June 2009 and completed by an independent safety consultant mutually agreed between the town and the Labour Department.
