Twelve years after Virk’s death, prosecutors continue fight against Kelly Ellard

Twelve years after Reena Virk was murdered in a Victoria park, prosecutors continue their fight to hold Kelly Ellard responsible in her death.

Crown prosecutors will be in Supreme Court Monday to appeal a decision made by the B.C. Court of Appeal last year, overturning Ellard’s second-degree murder conviction in the death Virk.

The 27-year-old has faced three trials in the case — two ending in convictions and one in a hung jury.

A judge ruled in September that the latest conviction be overturned because the judge in that trial didn’t explicitly warn the jury about how much weight to put on the testimony of a witness.

Ellard was 15 in 1997, when eight teenagers — seven of whom were girls — swarmed and beat Virk, then left her to drown in a river.
